Dow Receives SAFETY Act Liability Protection for Rail Security

While Dow is already a leader in the industry in security and emergency response, the Company recently received further recognition by becoming the first company ever to be awarded SAFETY Act coverage for its Rail Transportation Security Services from the U.S. Department of Homeland Security.
To earn this coverage, Dow’s Rail Transportation Security Services underwent a vigorous and thorough evaluation by the Department of Homeland Security. Dow earned this “designation” award from the Department for its best-in-class rail security program which includes, among other things: Assessment of Rail Transportation Security Threats and Vulnerabilities through a Comprehensive Risk Management System; Rail Transportation Security Countermeasures and Actions; Qualified Personnel and Training; Audits and Validations; and Emergency Preparedness and Community Response (including CHEMTREC® and TRANSCAER® Participation).
Dow’s business model has been built upon the belief that rail transportation of hazardous materials represents the safest, most efficient, most economical and most socially acceptable way of shipping large volumes of hazardous materials over long distances over land. With this SAFETY Act award, Dow’s rail program is now accredited as also being one of the most secure.

This is not the first SAFETY Act award Dow has received for its security activities. In 2007, Dow was the first chemical manufacturer to secure SAFETY Act coverage for the Company's comprehensive facility security services at 12 of its major manufacturing locations.

The SAFETY Act (Support Anti-Terrorism by Fostering Effective Technology) is a tort reform legislation passed by Congress to stimulate private industry to create, develop and implement important security products and services that protect key assets. The SAFETY Act affords risk management and litigation management protections for the approved providers of technologies and services and to others throughout the supply, distribution and user chain in the event of a terrorist act. This SAFETY Act award protects Dow from exposure to unquantifiable damages should an act of terrorism occur involving one of our raw materials, intermediates or products in rail distribution or tank cars.
